These Terms of Service ("Terms") govern your use of the Akasi website and application (the "Service"), owned and operated by Alnukhba Company for Computer Research and Studies (shortened to "Alnukhba Co.", "we", "us", or "our"). Our company is based in Kuwait.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Definitions

• Service: The Akasi website, application, and all related AI-driven features and services provided by Alnukhba Co.
• User Content: Any data, media, text, images, or other materials uploaded, input, or provided by you to the Service.
• Generated Content: The output, results, or materials created by the Service based on your input (User Content and prompts).
• Content: Collectively, User Content and Generated Content.

2. Eligibility and Access

You must be at least 18 years old to use the Service. If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Subscriptions, Payments, and Cancellation

3.1. Purchases

We offer both recurring subscriptions and one-time purchase options for various features of the Service. All fees are clearly stated at the point of purchase. You agree to pay all applicable fees associated with your use of the Service.

3.2. Automatic Renewal

Subscription services are billed on a recurring basis (e.g., monthly or annually) and will automatically renew unless cancelled by you.

3.3. Cancellation and No Refunds

You may cancel your subscription at any time directly through your account settings on the Akasi website. Cancellation will be effective at the end of your current billing cycle, and you will retain access to the Service until that date.

ALL FEES ARE NON-REFUNDABLE.

4. User Content and Intellectual Property

4.1. Ownership of Generated Content

You retain all rights, title, and interest in and to the Generated Content you create through the Service. You are solely responsible for compliance with any laws or third-party rights related to the Content you generate and use.

4.2. License to Alnukhba Co. (Data Retention Right)

By uploading User Content or generating Content using the Service, you grant Alnukhba Co. a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to retain, store, and use both your Uploaded Media and Generated Media solely for the purpose of maintaining, improving, and optimizing the Service ("future references"), including for model training, system diagnostics, and security analysis.

4.3. Content Privacy

The Service is designed such that only you can see your own uploaded and generated content. While we retain the right to store this data for system purposes (as outlined in 4.2), we will not intentionally access, share, or display your private Content to other users or third parties, except as required by law or as necessary for the maintenance and protection of the Service.

5. User Responsibility and Liability

5.1. Freedom of Action and Indemnity

You acknowledge that the Service is an AI tool where you have "freedom of action" over the inputs and prompts you provide, and the actions you take. Therefore, you are solely responsible and liable for your use of the Service and any resulting consequences.

5.2. Illegal Content and Prohibited Conduct

You must not upload, generate, or otherwise transmit any Content that is illegal, harmful, abusive, harassing, defamatory, vulgar, obscene, or violates any law in Kuwait or any other applicable jurisdiction.

ALNUKHBA CO. IS NOT LIABLE FOR ANY ILLEGAL CONTENT UPLOADED OR GENERATED BY USERS.

5.3. Confidential Information Warning

You are strongly advised NOT to upload or input any highly sensitive or confidential information, including, but not limited to, trade secrets, proprietary business data, personal financial information, or protected health information.

5.4. Right to Refuse Service

Alnukhba Co. reserves the right to reject, block, or refuse to process any user requests, inputs, or content deemed harmful, illegal, or inappropriate.

6. Disclaimer of Warranties and AI Accuracy

The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. You understand that the AI may produce inaccurate or incomplete outputs and must verify all Generated Content before relying on it.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait. Any legal action or proceeding shall be brought exclusively in the courts of Kuwait.
